Terms of Service
Effective date: 7 October 2026
These Terms of Service (“Terms”) govern your access to and use of TCM Diet Tool (“TCM Diet Tool”, “Service”, “we”, “us” or “our”).
TCM Diet Tool is currently operated by Jonathan Walsh, trading as TCM Diet Tool.
By creating an account or using the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.
1. About TCM Diet Tool
TCM Diet Tool is a practitioner-support tool designed primarily for Traditional Chinese Medicine (“TCM”) and acupuncture practitioners.
The Service allows practitioners to enter information from their own assessment of a client and generate dietary guidance and related practitioner-support content.
TCM Diet Tool may use automated systems and artificial intelligence as part of this process.
The Service is intended to support, rather than replace, the practitioner’s own professional knowledge, assessment and judgement.
2. Who may use the Service
TCM Diet Tool is intended for practitioners who have appropriate training, qualifications or professional competence to assess and advise their clients within the scope of their practice.
You must be at least 18 years old to create an account.
By using the Service in connection with professional practice, you confirm that you are responsible for determining whether you are appropriately qualified, authorised and insured to provide the services you offer to your clients.
You are also responsible for complying with any professional, regulatory, licensing or other requirements that apply to your practice in the country or jurisdiction in which you work.
3. Practitioner responsibility
TCM Diet Tool is a practitioner-support tool.
It does not replace the practitioner’s own clinical assessment, diagnosis, professional judgement or responsibility for their client.
You remain responsible for:
conducting your own appropriate assessment of the client;
determining the TCM pattern or other clinical interpretation you ultimately rely upon;
checking information generated by the Service;
deciding whether generated recommendations are appropriate for the individual client;
identifying contraindications, allergies, medical conditions, medications or other circumstances relevant to your advice;
modifying, rejecting or disregarding generated information where appropriate;
deciding whether a client should be referred to another healthcare professional; and
determining what information or recommendations you ultimately provide to the client.
You must review generated content before giving it to a client or relying upon it in professional practice.
You must not treat generated content as automatically correct merely because it was produced by the Service.
4. Not a substitute for medical care
TCM Diet Tool is not an emergency medical service and is not intended to replace appropriate medical investigation, diagnosis or treatment.
The Service should not be used to delay or discourage appropriate medical care.
Where symptoms or circumstances require medical investigation, urgent care, emergency treatment or referral to another appropriately qualified healthcare professional, the Practitioner remains responsible for responding appropriately within the scope of their professional responsibilities.
The Service does not guarantee that it will identify serious illness, medical emergencies, contraindications or conditions requiring referral.
5. Artificial intelligence and generated content
Parts of the Service use artificial intelligence and automated processing.
Artificial intelligence systems can produce information that is incomplete, inappropriate or incorrect.
Generated content may therefore contain errors even where the information supplied to the Service is accurate.
You agree to exercise appropriate professional judgement and human review before using generated content.
TCM Diet Tool does not guarantee that:
generated content will always be accurate;
every relevant consideration will be identified;
generated recommendations will be suitable for every client;
the same inputs will always produce identical wording or results; or
generated information will achieve a particular clinical or health outcome.
The Practitioner remains responsible for deciding whether generated content is appropriate for use.
6. Appropriate use of the Service
You may use TCM Diet Tool for legitimate professional purposes consistent with the intended function of the Service.
You must not:
use the Service unlawfully;
use the Service outside your professional competence in a way that could reasonably create a risk to another person;
deliberately enter false or misleading information for harmful purposes;
attempt to gain unauthorised access to another user’s account;
attempt to circumvent usage limits, subscription controls or security measures;
interfere with or disrupt the Service or its infrastructure;
attempt to obtain API keys, credentials, source systems or other protected technical information without authorisation;
use automated methods to excessively access, scrape or overload the Service;
resell access to the Service unless expressly authorised by us; or
use the Service in a manner that infringes the rights of another person.
We may suspend or restrict access where we reasonably believe the Service is being misused or where continued access creates a material security, legal or safety risk.
7. Client information
When entering information concerning a client, you must only submit information that you are legally entitled to process and instruct TCM Diet Tool to process.
You should only enter information reasonably necessary for the intended purpose.
You should avoid entering unnecessary direct identifiers such as a client’s full name, address, telephone number, email address or other identifying information into clinical free-text fields.
TCM Diet Tool is designed so that the separate client-name field is not intentionally included in clinical information submitted to the AI processing service.
However, information entered into free-text fields may itself identify an individual. You are responsible for avoiding unnecessary identifying information.
8. Data protection
Our Privacy Policy explains how we process information for which TCM Diet Tool acts as a controller, including practitioner account information.
Where TCM Diet Tool processes client personal data on your behalf, our Data Processing Agreement (“DPA”) applies.
When using TCM Diet Tool to process information concerning your clients, you are responsible for complying with applicable privacy, confidentiality and data-protection requirements relating to your professional practice.
Where you act as controller of client information, you are responsible for establishing the appropriate lawful basis and, where required, condition for processing health or other special-category information.
If there is a conflict between these Terms and the DPA concerning processing carried out by TCM Diet Tool on your behalf, the DPA takes precedence in relation to that processing.
9. Account security
You are responsible for maintaining the confidentiality and security of your account credentials.
You must not knowingly allow another person to use your account in a way that circumvents account, subscription or security requirements.
You should notify us promptly if you believe your account has been accessed without authorisation or your credentials have been compromised.
We may require you to reset credentials or take other reasonable security measures where necessary to protect the Service or its users.
10. Reports and downloaded information
Reports and other materials generated through TCM Diet Tool may be downloaded, printed or otherwise retained by the Practitioner.
Once a report or other information has been downloaded or removed from the Service environment, the Practitioner is responsible for its appropriate storage, security, retention, disclosure and deletion.
You should apply the same confidentiality and record-management standards to generated reports that you apply to other client information in your professional practice.
11. Ownership and permitted use
TCM Diet Tool, including its software, interface, branding, design, underlying systems and proprietary content, remains owned by TCM Diet Tool or its applicable licensors.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for its intended professional purpose.
You may use, download, print and provide reports generated for your clients as part of your professional practice.
Nothing in these Terms prevents you from using your own professional knowledge, clinical observations, ideas or other information that you independently own.
You may not copy, reproduce, reverse engineer, commercially redistribute or create a competing service from substantial protected elements of TCM Diet Tool except where permitted by law or expressly authorised by us.
12. Feedback
If you provide feedback, suggestions or comments about TCM Diet Tool, you allow us to use that feedback to improve and develop the Service.
This does not give us ownership of your client records, clinical case information or other personal data.
You should not include identifiable client information when providing general product feedback unless specifically necessary and appropriately authorised.
13. Beta and developing features
TCM Diet Tool may initially be provided as a beta, trial or developing service.
During beta testing, features may be changed, added, removed or temporarily unavailable.
You acknowledge that beta software may contain errors or behave unexpectedly.
We may ask beta users to provide feedback about usability, report quality or other aspects of the Service.
When providing beta feedback, you should avoid including unnecessary identifiable client information.
We may restrict the number of beta participants or end beta access at any time.
14. Availability of the Service
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.
The Service may occasionally be unavailable because of:
maintenance;
software updates;
infrastructure or third-party provider outages;
security incidents;
technical faults; or
circumstances outside our reasonable control.
We may modify the Service where reasonably necessary to improve functionality, security, compliance or reliability.
15. Third-party services
TCM Diet Tool relies on third-party technology and infrastructure providers to operate the Service.
These may include providers involved in cloud infrastructure, artificial intelligence, authentication, databases, payment processing and email delivery.
Relevant information about processing of personal data by these providers is described in our Privacy Policy and, where applicable, our Data Processing Agreement.
We are not responsible for independent third-party products or services that you choose to use separately from TCM Diet Tool.
16. Plans, trials and usage limits
TCM Diet Tool may offer free trials, limited free usage, paid subscriptions or other plans.
The features, report allowances and usage limits associated with a plan may be displayed within the Service or on the TCM Diet Tool website.
Free or trial access may be subject to limits and may be modified or withdrawn.
You must not create multiple accounts or use other methods for the purpose of improperly circumventing trial, report or subscription limits.
17. Paid subscriptions
Where paid subscriptions are offered, applicable pricing and billing frequency will be shown before purchase.
Payments may be processed by a third-party payment provider such as Stripe.
By purchasing a subscription, you authorise the applicable charges disclosed during checkout.
Unless otherwise stated during purchase, subscriptions may renew automatically at the applicable billing interval until cancelled.
Any applicable taxes may be added where required by law.
18. Cancellation
Where subscriptions are offered, you may cancel your subscription using the cancellation functionality provided by the Service or by contacting us where appropriate.
Cancellation prevents future renewal charges but does not ordinarily result in a refund for a subscription period that has already begun, except where required by applicable law or expressly stated otherwise.
Any statutory cancellation or consumer rights that cannot legally be excluded remain unaffected.
19. Changes to pricing
We may change subscription prices or plan structures in the future.
Where a price change affects an existing recurring subscription, we will provide reasonable advance notice where required and the new price will normally apply from a subsequent renewal rather than retrospectively to a period already paid for.
You may cancel the subscription if you do not wish to continue at the revised price.
20. Suspension and termination
You may stop using TCM Diet Tool at any time.
We may suspend or terminate access where reasonably necessary because:
you materially breach these Terms;
payment remains unpaid where a paid subscription is required;
your use creates a security or safety risk;
you misuse the Service;
continued provision would cause us to breach applicable law; or
we discontinue the Service.
Where reasonably practicable, we will provide notice before terminating access unless immediate action is reasonably necessary for security, legal or safety reasons.
Termination does not affect obligations that by their nature should continue after termination, including confidentiality, data protection, intellectual property and applicable liability provisions.
21. No guarantee of clinical outcomes
Health and dietary outcomes vary substantially between individuals.
TCM Diet Tool does not promise or guarantee that use of the Service or implementation of generated recommendations will:
improve a client’s symptoms;
prevent illness;
treat or cure a medical condition;
produce a particular therapeutic outcome; or
be suitable for every individual.
Practitioners must use their own professional judgement when determining what advice to provide.
22. Disclaimer of warranties
To the extent permitted by applicable law, the Service is provided on an “as available” basis.
While we aim to maintain a useful, reliable and secure Service, we do not warrant that the Service will always be uninterrupted, error-free or completely accurate.
Nothing in these Terms excludes warranties, rights or protections that cannot lawfully be excluded.
23. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded or limited.
Subject to those restrictions, TCM Diet Tool will not be responsible for losses arising solely from a practitioner’s failure to exercise appropriate professional judgement, failure to review generated content, misuse of the Service or use of the Service contrary to these Terms.
TCM Diet Tool will not be responsible for indirect or consequential losses to the extent such liability may lawfully be excluded.
Nothing in these Terms transfers the Practitioner’s professional responsibility for their clients to TCM Diet Tool.
The Practitioner remains responsible for professional decisions made using information generated through the Service.
24. Indemnity
To the extent permitted by applicable law, if your unlawful use of the Service, material breach of these Terms or infringement of another person’s rights causes a third-party claim against TCM Diet Tool, you will be responsible for losses and reasonable costs arising directly from that claim to the extent caused by your conduct.
This provision does not require you to indemnify TCM Diet Tool for losses caused by TCM Diet Tool’s own unlawful conduct, negligence or breach of its obligations.
25. Changes to these Terms
We may update these Terms where reasonably necessary to reflect:
changes to the Service;
new features;
changes to applicable law or regulation;
security or privacy requirements;
changes to third-party providers;
changes to subscription arrangements; or
changes to our business structure.
